I've heard the NHL will not allow Malkin and other unsigned Russian draft picks from 2004 and 2005 to re-enter the draft until the league has a transfer agreement with Russia for two years.

This in accordance with the new CBA. However, as Russia did not agree to transfer rights the NHL and players union has agreed that Russian players must be signed within 3 years of their original draft. This is what they are being told by team officials around the league. Red Line Report states that they have tried to confirm this with the NHL office who has no comment.

So, who know what will happen with Malkin.
