I thought it was pretty cool to finally hear Malkin's side of the story. It's amazing to me that the kid turned down over $3 million this year and went through all of that just to come here and play in the NHL. You have to respect the kid for that.

This appears to be a slam-dunk to me, except for the part late in Brief2 where it does say an employee can be liable for any direct damages. It also says though that these damages are typically limited to one month's salary.

I can't imagine that anything will go well for Magnitogorsk in this.

The legal papers are all filed in US Federal Court, that's why they are in English. As for the 2-week notices and his contract, I think they were prepared by his agents, that's why they are in English or in both, Russian and English.

I couldn't get a copy of the one-year contract that he was forced to sign for this year.

Good reading. It clearly states that duress is a recognized form of defense in Russia and renders any resultant contract voidable.

If you look at the complaint, one of MM's arguments is that the 2-week notice law doesn't apply to athletes. However, it says on the second brief that the athlete law was just proposed and hasn't been passed yet. One of the people behind the proposal of the legislation is Tretiak, the president of the Russian Ice Hockey Federation.

I found that pretty interesting. I also liked the part where they told Geno, that if the Pens sent them $2 million, they would let him out of his contract.

This is more fo my own research and professional work, but - which database does one have to search to get documents like those? I have Lexis-Nexis, but I don't think I'd be able to find it there (though I am not an expert user of that database, either). Thanks!

I got that stuff off of PACER. It's a federal court database that allows you to look at anything filed in any federal court in the U.S. I still have an acount from my last job. You have to pay for each search and each document, but it's not very much. I think it's $.08 a page.
