I just find it funny a person in his 20's (you are in your 20's right?) can't walk across ice without falling and then when you do fall, you try to find out "how injured do I have to be to sue?" C'mon man... stand up, dust yourself off, and go about your life.

So, if any of you were to fall on an iced sidewalk and get seriously injured you would just say, "oh well"?

ya probably. i should have been more careful where i was walking. if its 2 inches thick, you can see where it is. dont walk there.

Good luck with the lawsuit, right smak in the middle of your hearing, you'll find out that the apartment complex owner has ties to an Obama bundler, and your post here will show up via the NSA into the hands of their lawyers.

America Indeed. Then before you know it, money is missing off your counter and your daughter's knocked up... I've seen it a thousand times.


Also - these few days off will mean teachers will be complaining early June on FB about how much they work once when we get a nice sunny 80 degree day.

define seriously injured... the way he asks "how hurt do I have to be?" I would assume it's a bruise and maybe a sprain. If an 80 year old falls on some ice, breaks a hip and is in the hospital, then sure... they should get some compensation from the homeowner. It begs the question as to why an 80 year old would walk on a 2 inch thick sheet of ice though. You'd think they'd be smarter than that.

youd think someone who owns and operates a large apartment building in a nice neighborhood would have the decency and respect for its residence to bother with cleaning up the sidewalk.

so the "within 24 hours" is likely the sticking point. can you prove that it was there for longer than 24 hours of when it accumulated? is it 24 hours from when it starts accumulating or when it finishes accumulated? If it's a sprain and a bruise, you're likely better off just going on your way after the fall.

No heat in my building. Office is currently 50 degrees. Not sure why they aren't sending us home, especially since we have the capability to work remotely.

When it's not well lit and lightly covered with snow, ice is not always transparent. When you know it's there, obviously it's manageable, but it's crap to have to walk in the street for 20 yards because the complex ignores it's responsiblity.

What part of "how hurt do I need to get before I can sue?" isn't understood? It's asking how hurt does someone (presumably me) have to be before the company is punished for not clearing it's sidewalk. And for the 24 hour thing, it's been there since monday.

So did you not fall? Did you try contacting the company to let them know that there's ice there and they should clean it?

I believe property owners are responsible for keeping the sidewalks safe and clear.

He shouldn't have to call them. It's the law that they clear their sidewalks.

lol. I understand that it's the law. But sometimes a phone call is all it takes to get the job done. Call me crazy, but rather than wait for something bad to happen like a slip and fall, maybe call them, let them know there's an issue and then the slip and fall may never happen.

Also, if you've ever lived in a city and had to walk more than a few minutes to get anywhere you could encounter countless iced sidewalks. It would be impractical to call all of these property owners.

sounds to me he's talking about one particular complex.

I guess I'm just old fashioned in the sense that I don't like anyone that sues unless it's very warranted (ie, i don't care what the law says, use some common sense), and feel as though a phone call or conversation is better than getting lawyers involved. But hey, go call your lawyer, it's the law.

Yeah, while i'm sure that calling the complex could get some action....but my main issue is getting the city to enforce the law. I walk home after work from downtown sometimes when I can't bike, there are plenty of places that don't clear their sidewalks. That concert venue in the strip district and the complex on my street are the most difficult to navigate for me on my walk.

Come on, I'm not suggesting he calls a lawyer about the iced sidewalk. But if he falls and is seriously hurt then he should call one and you would too.

sure...but again, we're talking about "seriously hurt" broken bone? sure. need crutches for a few weeks? sure. fall over, bruise your butt and have a slightly tweaked ankle? nah...
