i had an employee who called off like 30 times in the span of 16 months. I wanted to get rid of her after like number 8 or 9. My boss was against it, as we didn't have anyone ready to take her spot, i guess. she had been written up to the point where she was on a final warning. The last straw was when she just decided not to show up for a week without calling off. she STILL got unemployment

I know next to nothing about unemployment-compensation law, so I can't be of much help. I do believe the fact that the former employer objected is not determinative of whether unemployment will be granted. I do know there are very short periods to appeal anything, so if unemployment is denied or the former employer files an appeal of the award of unemployment, I'd seek legal advice ASAP. I think the appeal time is something like 10 days.

He then went on a buying spree, purchased a washer and dryer, electric garage door opener with an extra remote, clothes, shoes and socks for his family. He attempted to up the initial level of credit in order to buy a pool table and I think a portable hot tub.

Grounds for termination: he had downloaded porn movies during work hours and would gather the employees that he was supposed to lead into his office for viewing parties. One employee called the ethics hotline and reported him. During the investigation, he figured out who the employee was and threatened to have him killed by a biker gang.

Day of termination, he was separated from his office so security could gather his personal items. It was then that the Sears card was discovered because he had multiple past due statements issued to the company.

Fraud of up to $5,000 in the companies name with Sears, hard drive of porno galore, physical threats of retaliation, misuse of company property. He filed for unemployment and was awarded full benefits. We appealed, and the state replied that the company was at fault for not providing prior documented discipline, and that there were no documented procedures on how to handle a credit card solicitation in the companies name.

no, that was an employee not getting fired after he told me to f--- myself after i told him not to sleep on the job. the above situation was back in baltimore

You should talk to (a good) lawyer. There may very well be a viable lawsuit in those facts.
